International human rights law pays significant attention to the procedural rights of young offenders. Legal procedure is conceived as an important element securing the fairness of criminal justice in general and in juvenile cases in particular. One of the requirements of international law is that juvenile offenders have a right to be treated differently. Each juvenile case requires an individualized approach to meet the goals of education. The principle of individualization in juvenile criminal cases comes into tension with the principle of the prohibition of discrimination and the principle of equal application of law (treating like cases alike). This comment illustrates this tension through the examination of procedural fairness in Thai juvenile courts in the light of international law.

Digital economy is developing rapidly worldwide. New digital opportunities create new business opportunities like online taxi. The existence of online taxi in Indonesia is unavoidable because the developing of digital economy. Online taxi, like Grabcar and Gocar is operated its business through digital platform, such androids application (smartphone application). It makes customer easier to order and the rate of online taxi is cheaper than conventional taxi rate. The competition conventional taxi and online taxi is unavoidable. From the demand (consumer) side taxi online conventional taxi is in the same relevant market. They compete each other very fierce. The market share and income conventional taxi supposed decreased. The taxi online supposed doing price cartel. The question is how to determine that online taxi is occuring price cartel. This paper will attempt to analyze and provide feasible solutions concerning the regulation of Algorithm-Based Price Cartels in the Taxi-Online Business in Indonesia.

THE CONFLICTS BETWEEN COPYRIGHT AND THE NORMS OF ONLINE RE-CREATIONS: AN EMPIRICAL ANALYSIS

As a fundamental principle, by granting exclusive rights, copyright provides economic incentives to encourage authors and artists to express their ideas, and in that process, create a new work. As a general rule, when using a protected work, a person needs permission from the copyright holder of such work. However, this article finds that: economic interests provided by copyright are not the primary incentives for authors to create a work; and due to some obstacles, people cannot conform to the copyright rule that permission to use a copyright work is required. These conclusions are supported by an original empirical study on the social norms concerning the practice of online re-creations.
