https://so01.tci-thaijo.org/index.php/HIKMAH/article/view/269425

This research aims 1) to study the perspectives of Islamic scholars on establishing the legal guidelines for the use of medical technology to aid infertility treatments, and 2) to provide information to Islamic organisations as an alternative for accurately explaining practices in alignment with religious principles. This qualitative research involves examining sources from the Quran, As-Sunnah, and writings from the four schools of Islamic thought, as well as academic materials from contemporary scholars and fatwa rulings issued by Islamic countries. The analysis and critique of these documents were conducted in a non-empirical manner, organising varying opinions according to Usululfiqh principles. The researcher's findings and interpretations were that Islamic scholars endorsed the use of medical technology to address infertility issues, specifically through two forms of fertilisation: intrauterine and extrauterine. This approval is based on necessity as a key criterion, and it is permissible only when utilising the semen of the husband and the eggs of the wife who are legally married according to religious laws. Any other method is prohibited. Furthermore, the information gathered confirms the legitimacy of the lineage rights of children from lawful marriages, providing academic support for Islamic organizations and relevant agencies to enhance societal understanding.
abdulroya benseng
