<p><strong>Aim and Scope</strong></p> <p>The Graduate Programs, Faculty of Law, Thammasat University, publishes the <em>Graduate Law Journal</em> with the objective of disseminating academic knowledge in various fields of law, including civil law, business law, criminal law, public law, international law, tax law, natural resources and environmental law, among others. The Journal also encompasses knowledge from other disciplines related to legal studies, such as the administration of justice.</p> <p>The publication of academic articles aims to foster the development of legal scholarship and related interdisciplinary fields. <p>Nowadays, resolving conflicts through litigation can be excessively complex, unreasonably delayed and astronomically priced. As a result, disputing parties increasingly opt for Alternative Dispute Resolution (ADR) to resolve their disagreements. One prominent method of ADR is mediation, which is widely used around the world, including in Thailand.</p> <p>Since the Dispute Mediation Act, B.E. 2562 (2019) was only promulgated in Thailand a few years ago, the comparative analysis can offer valuable insights for Thailand, particularly in further improving the effectiveness of this legislation and addressing emerging challenges. Therefore, this comparative study of mediation law in Thailand and England aims to highlight strengths and limitations in each system. The research focuses on 5 issues: the historical background, cases eligible for mediation, the mediation procedure, mediators and fees. </p> <p>The outcomes of this research suggest that both Thailand and England can incorporate the strengths of the system in another country to enhance mediation law in their jurisdiction. For example, Thailand may consider the introduction of mediation in family disputes, while England may reevaluate its current stance to allow mediation in criminal cases.
