THE MODEL OF LEGAL JUSTICE PROCESS FOR CONTROLLING THE DONATED MONEY

This research aimed to address the following objectives: 1) studying issues related to donation solicitation, 2) identifying gaps in existing laws concerning donation solicitation, and 3) developing a legal model for the creation and effective implementation of new laws concerning donation solicitation. This research adopted a qualitative research method by analyzing documentary data including in-depth interviews with 11 stakeholders. In addition, foreign laws were analyzed in comparison with Thai laws to answer the research objectives. The research findings revealed that:The current donation solicitation has changed to different forms by using social media presenting content and illustrations to create sympathy or by organizing activities to raise more donations. In addition, nowadays, money is rapidly transferred via electronic transactions, so the scammers exploit legal gaps to seek benefits. Therefore, it seems appropriate to improve the new law in order to develop a legal justice system, control and supervise donated money by drafting the Solicitation or Donation Control Bill Amendment B.E. ..
