การควบคุมธุรกิจการพนันในประเทศไทย : ศึกษาเฉพาะกรณีธุรกิจการพนันออนไลน์

Abstract

การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อศึกษา 1) ความเป็นมาและความสำคัญของปัญหาในการควบคุมธุรกิจการพนันในประเทศไทย 2) แนวคิดเกี่ยวกับมาตรการบังคับใช้กฎหมายสำหรับการพนันและการพนันออนไลน์ 3) เปรียบเทียบระหว่างกฎหมายเกี่ยวกับการพนันของประเทศไทยกับกฎหมายเกี่ยวกับการพนันและพนันออนไลน์ต่างประเทศ 4) วิเคราะห์ปัญหาเกี่ยวกัาบกาาควบคุมธุรกิจการพนันออนไลน์ในประเทศไทย 5) เสนอแนะมาตรการที่จะนำมาใช้ในการป้องกัน หรือควบคุมการเล่นพนันออนไลน์ แบบของการวิจัย คือ การวิจัยเอกสาร ใช้ระเบียบวิธีวิจัย เชิงคุณภาพ ประชากร หมายถึง แหล่งข้อมูล ได้แก่ หนังสือ ตำรากฎหมาย คำพิพากษาศาลฏีกา วิทยานิพนธ์ งานวิจัย วารสาร การสัมภาษณ์เจ้าหน้าที่ที่เกี่ยวข้องกับการบังคับใช้กฎหมายและข้อมูลจากเว็บไซต์ต่าง ๆ การวิเคราะห์ข้อมูลโดยการวิเคราะห์เนื้อหา ผลการศึกษาพบว่า 1) การพนันมีอยู่คู่บ้านเมืองมาเป็นเวลาช้านาน มีการสันนิษฐานกันว่าการพนันได้แพร่หลายเข้ามาในประเทศไทยพร้อมกับการติดต่อค้าขายจากจีน โดยเริ่มตั้งแต่สมัยกรุงสุโขทัยเป็นต้นมา แม้การพนันจะเป็นอบายมุขแต่การพนันก็เป็นกิจกรรมที่คนไทยจำนวนมากนิยมเล่นกัน ไม่ว่าจะเป็นการพนันที่กฎหมายอนุญาตให้มีการเล่นได้ เช่น สลากกินแบ่งรัฐบาล สลากออมสิน การแข่งม้า ฯลฯ รวมทั้งการพนันผิดกฎหมาย เช่น  หวยใต้ดิน การพนันทายผลกีฬา ทายผลบอล บ่อนการพนัน เป็นต้น การพนันออนไลน์ นับเป็นเกมการพนันข้ามชาติที่มีอัตราการเจริญเติบโตอย่างรวดเร็วมากในช่วงทศวรรษที่ผ่านมา ในประเทศไทยการขยายตัวของการพนันออนไลน์ก็เป็นไปอย่างรวดเร็วเช่นเดียวกับหลายประเทศทั่วโลก โดยมีการให้บริการ ใน 4 รูปแบบหลัก คือ ทางผลล็อต
เตอรี่ออนไลน์ ทายผลเกมพนันแบบคาสิโน และทายผลการแข่งขันท่ัวไป 2) ในช่วงแรกประเทศไทยมุ่งที่การแสวงหารายได้หรือผลประโยชน์จากการพนันมากกว่าการจำกัดหรือควบคุมการเล่น ต่อมาในปี พ.ศ. 2473 ได้มีกฎหมายการพนันขึ้นเป็นฉบับแรก จากนั้นแนวคิดเกี่ยวกับการพนันก็ได้เปลี่ยนจากการแสวงหาผลประโยชน์มาเป็นการควบคุม 3) ประเทศอังกฤษ ประเทศออสเตรเลีย และเขตปกครองพิเศษฮ่องกง ถือว่าการพนันออนไลน์เป็นสิ่งที่ถูกกฎหมาย รัฐอนุญาตให้มีการพนันออนไลน์ได้ โดยมีการออกกฎหมายและมีมาตรการตรวจสอบเฝ้าระวังธุรกิจได้รับอนุญาตอย่างเข้มงวด และมีโทษสำหรับผู้ที่ฝ่าฝืน สำหรับประเทศสหรัฐอเมริกา การพนันออนไลน์ถือเป็นสิ่งผิดกฎหมาย มีกฎหมายห้ามการประกอบธุรกิจการพนันออนไลน์ทุกประเภทและการทำธุรกรรมทางการเงินที่เกี่ยวข้อง เช่นเดียวกับประเทศไทยที่ถือว่าการพนันออนไลน์เป็นสิ่งผิดกฎหมาย 4) ปัญหาเกี่ยวกับการควบคุมธุรกิจการพนันออนไลน์ในประเทศไทย ได้แก่ ปัญหาทางกฎหมายเกี่ยวกับการพนัน เช่น ปัญหาเกี่ยวกับทัศนคติของสังคมต่อการกระทำความผิดปัยหาเกี่ยวกับเนื้อหาสาระแห่งกฎหมาย และปัญหาการบังคับใช้กฎหมาย ปัญหาเฉพาะของการเล่นพนันออนไลน์ เช่น การไม่เปิดเผยตัวตนของผู้เล่น ปัญหาเรื่องเขตอำนาจศาล และการพิสูจน์ความผิด ปัญหาการตีความตาม พ.ร.บ. ว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 5) เสนอแนะแนวทางแก้ไข โดยแก้ไขปรับปรุงพระราชบัญญัติการพนัน พ.ศ. 2478 แก้ไขปรับปรุงพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 และเพิ่มมาตรการในการบังคับใช้กฎหมาย

The purposes of this research were to study: 1) the background and problems of online gambling  business  in Thailand  2) the concept of law enforcement measures about gambling and online gambling 3) the comparison of online gambling law of Thailand and others’ foreign countries 4) the analyzing  online gambling  in Thailand   5) the  proposal  of preventive   and controlling measures of online gambling. Research methodology employed is document research which is qualitative-oriented. Key informations are the information resources namely books, legal document, Judgment of the Supreme  Court,  thesis,  research, academic journals and interviews with the government officials as well as information from web-based resources. The data were analyzed by content analysis. The findings of the study reveal that 1) gambling exists in Thai culture from the past until  now. It is assumed  that the gambling business widely  spreads in  Thailand from becoming business partner with  Chinese in Sukhothai era. Even though the gambling  is illegal,  it  becomes popular among Thai gambling  not only the legal  gambling  like lottery, Thai  saving  Bank  lottery, and horse racing  , but  also  the  illegal  lottery, sport gambling, and illegal casino. Online gambling is considered as a fast growing international gambling business in a last few decades. The online gambling business share the following four characteristics as online gambling in other parts   of  the  world   ; online   lottery   and  sport gambling  especially  guessing  the result of a football game, casino gambling, and the result of other  competitions.   2) In the  beginning, Thailand would like to gain the benefits from gambling business rather than control it until the B.C  2473, there was  the first Gambling Act  3) Although  in England, Australia,  and Hong Kong, online gambling is considered as legal, there are online gambling acts that were to investigate, punish the legal breakage and strictly control the gambling activities.  In the United States of America,  online gambling is considered illegal and there is the Gambling Act controlling all types of online gambling activities and business transaction related the same as the Act  in  Thailand. 4) problems of online gambling   business   in  Thailand   are (4.1) legal problems about gambling such as the attitudes, the contents of the law, and law enforcement (4.2) problems   of online  gambling   such  as the anonymity  of the players, Jurisdiction  issues and  the  investigation   (4.3) problems  of the Computer Offense Act B.E. 2550’s interpretation 5) suggestions   of the  improvement   of the Computer Offense Act B.E. 2550
