Legal Right Recognition to Same-Sex Couple’s Relationship in Germany

Abstract

The German legal system is unique in recognizing the legal right to same-sex couple’s relationship. Although the value of the institutional marriage as union between man and woman is recognized and guaranteed the special protection from state. In another dimension, life partnership, non-marital status for same-sex relationship is recognized and protected as well as marriage. The Federal Constitutional Court of the Federal Republic of Germany plays a vital role in the protection of legal rights to same-sex couple’s relationship through a court decision recognizing that same-sex couples have the same rights and duties under the various statutes as well as heterosexual married couples. At the same time, it may be an another important factor that has contributed to the extension of the right tomarriage to same-sex couples in Germany, apart from other significant social and cultural factors.
