THE ROLE OF THE CONSTITUTION OF THE KINGDOM OF THAILAND 2017 WITH ECONOMIC AND SOCIAL DEVELOPMENT

Abstract

The constitution is the supreme law of the country. It's the master law over all other laws as it defines the structure, authority, duties of government organizations, and also relationship status of sovereign user organizations among one another and to the people. The Constitution therefore is directly related to the economy and society as the main structure of the socio-economic system. Even though the state grants the private sector economic freedom in running business, the rules are all enforced by the government. Some guidelines cause problems and hinder economic activity, leading to social problems. Some criteria favor capital groups, which monopolize economic power. For economic and social progress, there is a balance of trade and investment. Property entitlement, considering as cost of production, freedom of business or occupation and freedom of competition freely and fairly, will transform society. That's why economic freedom must be certified in the Constitution. Consequently, whenever social transformation exists, inequality takes place. If the rules set out in the Constitution are inconsistent or unfavorable for economic and social development, the constitution should also be changed to be consistent with the changing socio-economic conditions.
