วิเคราะห์ข้อกฎหมายเกี่ยวกับหลักธรรมาภิบาลและการมีส่วนได้เสียของคณะกรรมการสรรหาอธิการบดีมหาวิทยาลัยราชภัฏ

บทบัญญัติแห่งกฎหมายในเรื่องที่เกี่ยวกับการแต่งตั้งกรรมการสรรหาอธิการบดีที่มาจากกรรมการสภามหาวิทยาลัยนั้น ถ้าสภามหาวิทยาลัยได้ดำเนินการตามกรอบแห่งกฎหมายภายใต้มาตรา 18 มาตรา 28 มาตรา 29 แห่งพระราชบัญญัติราชภัฏ พ.ศ. 2547 ไม่ขัดต่อหลักธรรมาภิบาลตามมาตรา 9 แห่งพระราชบัญญัติการอุดมศึกษา พ.ศ. 2562 แต่อย่างไรก็ตามก็ยังมีประเด็นปัญหาที่โต้แย้งในเรื่องของกรรมการสรรหาอธิการบดีที่มาจากตัวแทนกรรมการสภามหาวิทยาลัยมาทำหน้าที่สรรหาและทำหน้าที่พิจารณาแต่งตั้งอธิการนั้นเป็นผู้มีส่วนได้เสียภายใต้พระราชบัญญัติวิธีปฏิบัติราชการทางปกครอง พ.ศ. 2539 มาตรา 13 หรือไม่ คู่กรณีตามมาตรา 13 คือ ผู้เข้ารับกรรมการสรรหาอธิการบดี สามารถโต้แย้งการพิจารณาของกรรมการสภาตามมาตรา 15 หรือ กรรมการสภามหาวิทยาลัยโต้แย้งตามมาตรา 16 ได้และผลที่การพิจารณาของสภามหาวิทยาลัยที่ตนไม่เห็นด้วยสามารถนำไปฟ้องคดีต่อศาลปกครองขอให้เพิกถอนมติของสภามหาวิทยาลัยได้
