บทคัดย่อ

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางพัฒนาพระราชบัญญัติว่าด้วยการปรับเป็นพินัย พ.ศ. 2565 โดยวิธีการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสาร ศึกษากฎหมายของประเทศสาธารณรัฐฟินแลนด์ และสหพันธ์สาธารณรัฐเยอรมนี เปรียบเทียบกับกฎหมายไทย

ผลการวิจัยพบว่าแนวทางที่จะพัฒนาพระราชบัญญัติว่าด้วยการปรับเป็นพินัย พ.ศ. 2565 นั้น จะต้องมีการนำระบบวันปรับ (Day Fine System) มาใช้ เพื่อให้การปรับเป็นพินัยนั้นมีระบบที่คำนึงถึงฐานะทางเศรษฐกิจของผู้กระทำความผิดโดยชัดเจน นอกจากนี้ควรนำการปรับเป็นพินัยไปใช้กับประมวลกฎหมายอาญา เพราะประมวลกฎหมายอาญา มีฐานความผิดหลายฐานที่มีอัตราโทษปรับเพียงอย่างเดียว และควรนำการปรับเป็นพินัยมาใช้กับความผิดที่มีอัตราโทษจำคุกด้วย ไม่ควรนำมาใช้เฉพาะความผิดที่มีอัตราโทษปรับเท่านั้น เพื่อเป็นการแก้ไขปัญหานักโทษล้นเรือนจำในประเทศไทย

งานวิจัยนี้มีข้อเสนอแนะให้แก้ไขพระราชบัญญัติว่าด้วยการปรับเป็นพินัย มาตรา 9 วรรคหนึ่ง มาตรา 39 และมาตรา 40 และบัญชี 1 ท้ายพระราชบัญญัติว่าด้วยการปรับเป็นพินัย
