The Next Step of the Law on Protection of Domestic Violence Victims

Abstract

         After enforcement of the Protection of Domestic Violence Victims Act B.E. 2550 for a period, there have been several problems found. Therefore, public sector strives to solve them by proposing of the Drafting Welfare Protection of Person in the Family Act B.E. ...... There are considerable issues uncovered from studying such drafting act. In this paper, it is going to raise three significant issues to study. First, according to the drafting act, the court shall have the power to prescribe for prohibiting person who commits domestic violence entering or moving out of the dwelling or residence, even though that person is the owner or has the legal right on it. This empowerment should be considered whether it is unreasonable affecting to the right and liberty of such person as the owner or not? This study finds out that it is reasonable because this drafting act was done for the sake of public benefit which has an advantage over individual benefit. Next issue, when victim of domestic violence is an elderly person, should there be any other additional protection measures to the drafting act? It recommends that the following measure should be added, i.e., the court shall have the power to order to revoke the gift because the donee commits domestic violence against the elderly donor. Finally, any person who witnesses or knows the act of domestic violence shall notify the competent officers, but there is no provision of any punishment or measure for the person who does not act as prescribed by this drafting act. Is the provision regarding to the notification sufficient for raising awareness of everyone to take parts of this solution together? It shows that this issue is not

fulfilled. Public sector should continually co- operate with all sectors nationwide to provide knowledge and raise the campaign, “anti-domestic violence”.
