งานวิจัยเรื่องนี้มีวัตถุประสงค์เพื่อศึกษาพัฒนาการของหลักความเท่าเทียมระหว่างเพศ
ในระบบกฎหมายไทย วิเคราะห์ปัญหาและอุปสรรคในการบังคับใช้พระราชบัญญัติความเท่าเทียมระหว่างเพศ พ.ศ. 2558 รวมถึงเสนอแนวทางปรับปรุงร่างพระราชบัญญัติความเท่าเทียมระหว่างเพศ (ฉบับที่ ..) พ.ศ. .… ให้สอดคล้องกับหลักสิทธิมนุษยชนสากลและบริบทสังคมไทยปัจจุบัน การวิจัยใช้ระเบียบวิธีวิจัยเชิงเอกสาร (Documentary Research) ศึกษาจากบทบัญญัติแห่งกฎหมาย เอกสารวิชาการ รายงานระหว่างประเทศ และการเปรียบเทียบกฎหมายต่างประเทศ ได้แก่ Equality Act 2010 ของสหราชอาณาจักร, Basic Law ของสหพันธ์สาธารณรัฐเยอรมนี และอนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) ขององค์การสหประชาชาติ
ผลการวิจัยพบว่า พระราชบัญญัติความเท่าเทียมระหว่างเพศ พ.ศ. 2558 เป็นกฎหมายที่มีเจตนารมณ์สำคัญในการคุ้มครองบุคคลจากการถูกเลือกปฏิบัติโดยไม่เป็นธรรมระหว่างเพศ แต่ยังมีข้อจำกัดในหลายประการ ทั้งในด้านคำจำกัดความของ “การเลือกปฏิบัติ” และ “เพศ” ที่ไม่ครอบคลุมถึงอัตลักษณ์ทางเพศ (Gender Identity) และการแสดงออกทางเพศ (Gender Expression) อีกทั้งกลไกการบังคับใช้ของคณะกรรมการวินิจฉัยการเลือกปฏิบัติโดยไม่เป็นธรรมระหว่างเพศ (วลพ.) ยังขาดความเป็นอิสระและประสิทธิภาพในการคุ้มครองสิทธิ การบังคับใช้ในทางปฏิบัติยังไม่สามารถป้องกันการเลือกปฏิบัติทางอ้อมในสถาบันการศึกษา สถานที่ทำงาน และหน่วยงานของรัฐได้อย่างทั่วถึง
ดังนั้น งานวิจัยนี้เสนอให้มีการปรับปรุงร่างพระราชบัญญัติความเท่าเทียมระหว่างเพศ (ฉบับที่ ..) พ.ศ. …. โดยเพิ่มนิยามทางกฎหมายให้ครอบคลุมบุคคลหลากหลายเพศ ขยายขอบเขต ความคุ้มครองจากการเลือกปฏิบัติทางตรงและทางอ้อม เสริมอำนาจหน้าที่ของ วลพ. ให้มีสถานะเป็นองค์กรอิสระภายใต้หลักความโปร่งใสและตรวจสอบได้ พร้อมทั้งกำหนดกลไกการมีส่วนร่วมของประชาชนและภาคประชาชนสังคมในการติดตามและประเมินผล เพื่อให้กฎหมายดังกล่าวสามารถส่งเสริมหลักสิทธิมนุษยชน ความเสมอภาค และศักดิ์ศรีความเป็นมนุษย์ได้อย่างแท้จริง
