The Thai Law Concerning Unruly Passengers on Board: A study on Jurisdiction and Administrative Sanctions

Abstract

The unruly passenger on board is a problem addressed in the Protocol to Amend the Convention on Offences and Certain Other Acts Committed on Board 2014 (Montreal Protocol 2014) and other documents published by the International Civil Aviation Organization. Their main objective is to advise States on expanding the scope of jurisdiction and converting criminal penalties to administrative sanctions. Thailand is not a party to the Montreal Protocol 2014. Therefore, this paper aims to examine to what extent Thai law on both mentioned issues is consistent with both international law and documents published by the International Civil Aviation Organization.
