การชันสูตรพลิกศพตามบทบัญญัติอิสลาม

Abstract

The objective of the research is conducted to study the corps’s dignity and the performance on the post- mortem inquests on the Muslims corps in accordance to Islamic Regulations. In addition, this research attempts to study the viewpoint of Muslim scholars in the area on the post- mortem inquests on the Muslim’s corpse in Thailand. This qualitative research is using two main methods; documentary research is collected data from different sources include Al-Quran, Al-Hadith as well as  Thai post-mortem law reference books and field research is collected data using In depth Interview with Muslim scholars in the area. The sample group consisted of 16 Muslim scholars; representatives for Provincial Islamic Committee in the area; Pattani, Yala, Narathiwat and Songkhla and representatives for Islamic higher education institutions in the area. The data was analyzed by description analysis. The result revealed that everyone is equal in dignity, humanity right because in the Islamic concept regarded as all humanity are from Adam u. The post-mortem inquests on Muslim corpses in Islamic regulation should be based on the Islamic jurisprudence principles of necessity and interest. Majority of the Muslim scholars’ view that the post-mortem inquests on Muslim corpses in Thailand should be allowed if there is the complete rule and staff for post-mortem inquests on Muslim corpses arranged by the government and conform to the Islamic  concept. This research helps to distinctly understand the performance on the post-mortem inquests on the Muslims corps in accordance to Islamic Regulation and the need of the Muslim scholars and their useful suggestion be consider as new basic for the performance on the post- mortem inquests on the Muslims corps in accordance to Islamic Regulation in Thailand
