Abstract

ملخص البحث

          يهدف البحث إلى دراسة واقع المصرف الإسلامي بتايلاند، والقوانين واللوائح المتعلقة به، فضلا عن التحديات التي يواجهه. واعتمد البحث على المنهج الاستقرائي والتحليلي، وذلك بجمع المواد العلمية من المصادر والمراجع والأبحاث المعاصرة والتقارير السنوية وتحليلها، فضلا عن المعلومات ذات الصلة بها من خلال المقابلة الشخصية المتعمقة مع الهيئة الاستشارية للمصرف الإسلامي بتايلاند. وتوصلت الدراسة إلى أن المصرف الإسلامي بتايلاند قد أثبت وجوده وتطوره من خلال مسيرته من عام 2003م إلى عام 2015م، وعمل المصرف الإسلامي بتايلاند وفق قانون المصرف الإسلامي بتايلاند لعام 2002م والقانون الضريبي لعام 1937م وقانون الآراضي لعام 1954م وقانون الأوراق المالية وسوق الأوراق المالية لعام 1992م والقانون في وكالة المعاملات في سوق الأوراق المالية لعام 2007م وقانون حماية الودائع المصرفية لعام 2008م، فضلا عن اللوائح والإعلانات الوزارية الخاصة به. وواجه المصرف الإسلامي بتايلاند التحديات الكثيرة منها عدم وجود القوانين واللوائح الكافية والملائمة مع طبيعته، وندرة الموارد البشرية المؤهلة، وعدم القدرة على تطوير وابتكار منتجات ملبية احتياجات المتعاملين، ومحدوية مجال الاستثمار وغيرها. واقترحت الدراسة تطوير القوانين واللوائح لتتناسب مع بيئة المصرفية الإسلامية، وإنشاء هيئة شرعية مستقلة لدى المصرف المركزي وتطوير سوق الأوراق المالية الإسلامية لتلبية حاجة المصرفية الإسلامية في السيولة والاستثمار، وإنشاء قسم التدريب وتنمية الموارد البشرية في المصرف الإسلامي بتايلاند، وتنويع أدوات التمويل الممنوح ليشمل أدوات التمويل المخاطر كالمشاركة والمزارعة والاستصناع والسلم وغيرها من الأدوات المؤثرة في عملية التنمية الاقتصادية.

ABSTRACT

This research aims to study the fact of Islamic Bank of Thailand, the related legislations and regulations, and its challenges. The inductive and analytical methods were used in this study. The data were collected and analyzed from sources, resources, contemporary studies, annual reports, including in-depth interview with the advisory board of the Islamic Bank of Thailand. The study finds out that The Islamic Bank of Thailand was established and developed during its operation from 2003 to 2015. It operates according to the Islamic Bank of Thailand Act 2002, the Tax Act 1937, the Land Act 1954, the Securities and Capital Market Act 2007, the Trust for Transactions in Capital Market Act 2007, and the Deposit Protection Agency Act 2008 relating to Ministry’s regulations and announcements. The Islamic Bank of Thailand faces many challenges, such as insufficient and unsuitable laws and regulations according to its nature, lack of skilled human resources, unable to invent new products to suit customers’ needs, and limited field of investment. According to this study, it recommends that the legislations and regulations should be developed in order to fit the Islamic Bank environment and to appoint the independent Shariah Advisory at the level of Central Bank. Moreover, the Islamic capital markets need to be developed to serve the needs of Islamic Bank in liquidities and investment. Human resource and training department also need to be established within the Islamic Bank of Thailand. Finally, variety of instruments in the field of financing are also necessary in order to cover the risk instruments, such as Musharakah, Muzara¢ah, Salam, Istisna¢ and other effected instruments to economic development.
