Patent Law and Development: Study on Patent Infringement Exception for Experimental Purpose

Abstract

The patent laws not only provide the protection on the right owners’ exploitation but also provide the protection on the public interest in order to balance the benefits of both parties. For the public interest protection, the laws permit other persons who are not the right owners to use the patented invention without the authorization from the right owners, for example, for the purpose of experiment or so called “patent infringement exception for experimental purpose”. This article is intended to study and analyze the implementation of the experimental use exception at the international level in order for each country to follow. This paper is based on the studying from the Trans-Pacific Strategic Economic Partnership Agreement which specifically provides for this exception, in comparison with the patent laws in some countries.

กฎหมายสิทธิบัตรกับการพัฒนา: ศึกษากรณี ข้อยกเว้นการละเมิดสิทธิบัตรเพื่อการทดลอง

กฎหมายสิทธิบัตรไม่เพียงแต่ให้ความคุ้มครองการแสวงหาประโยชน์ของเจ้าของสิทธิบัตรเท่านั้น แต่ยังให้ความคุ้มครองประโยชน์สาธารณะด้วยเพื่อรักษาความสมดุลระหว่างประโยชน์ของทั้งสองฝ่าย โดยการคุ้มครองประโยชน์สาธารณะนั้น จะเห็นได้จากการที่กฎหมายกำหนดให้บุคคลอื่นที่ไม่ใช่เจ้าของสิทธิบัตร สามารถนำสิ่งประดิษฐ์ที่ได้รับความคุ้มครองสิทธิบัตรมาใช้ประโยชน์โดยไม่ต้องขออนุญาตจากเจ้าของสิทธิบัตร เช่น การนำมาใช้ประโยชน์เพื่อวัตถุประสงค์ในการทดลอง หรือที่เรียกว่า “ข้อยกเว้นการละเมิดสิทธิบัตรเพื่อการทดลอง” ซึ่งบทความฉบับนี้มีวัตถุประสงค์เพื่อศึกษาและวิเคราะห์การกำหนดข้อยกเว้นการละเมิดสิทธิบัตรเพื่อการทดลองนี้ไว้ในระดับระหว่างประเทศ เพื่อเป็นแนวทางสำหรับประเทศต่างๆ ที่จะปฏิบัติตามต่อไป โดยศึกษาจากความตกลงหุ้นส่วนยุทธศาสตร์เศรษฐกิจเอเชีย-แปซิฟิก ที่ได้กำหนดข้อยกเว้นดังกล่าวไว้เป็นการเฉพาะ เปรียบเทียบกับกฎหมายสิทธิบัตรของบางประเทศ
