The Promotion of Work Opportunity for the Elderly through Law Reform

บทคัดย่อ

In present, there are many laws enacting in relation to the elderly, but none of them specifies any promotion or protection of their working. Moreover, some important laws and regulations directly and indirectly impede their labor force participation. Hence, in order to promote the opportunity for the elderly to work longer in the labor market, those laws and regulations, for example the Labour Protection Act B.E. 2541 (1998), and the Civil Services Act B.E. 2551 (2008), are needed to be revised.

ในปัจจุบันนี้มีกฎหมายไทยหลายฉบับที่มีบทบัญญัติเกี่ยวกับผู้สูงอายุ แต่ไม่มีฉบับใดที่ส่งเสริมและคุ้มครองการทำงานของผู้สูงอายุเป็นพิเศษ อีกทั้งยังมีกฎหมาย และระเบียบสำคัญที่เป็นอุปสรรคโดยตรงและโดยอ้อมต่อการเข้าร่วมกำลังแรงงานของผู้สูงอายุ ดังนั้นเพื่อที่จะสนับสนุนให้ผู้สูงอายุมีโอกาสทำงานอยู่ต่อไปในตลาดแรงงานได้ยาวนานขึ้นกฎหมาย ระเบียบต่างๆ เช่น พระราชบัญญัติคุ้มครองแรงงาน พ.ศ. 2541 พระราชบัญญัติข้าราชการพลเรือน พ.ศ. 2551 เป็นต้น จำเป็นที่จะต้องได้รับการปรับปรุง
