Abstract

Currently, the casino industry plays a significant economic role in many countries worldwide. It contributes not only to revenue generation through taxation but also to tourism promotion and employment creation. Nevertheless, Thailand still prohibits legal casino operations under the Gambling Act B.E. 2478 (1935), which fails to accommodate contemporary forms of gambling, especially digital and online casino platforms. The lack of a specific legal framework to govern online gambling has resulted in regulatory gaps and enforcement challenges. In response, the Draft Act on the Operation of Integrated Entertainment Complex Businesses B.E.... has been proposed to regulate casino establishments in a lawful and controlled manner, aiming to mitigate adverse social, economic, and criminal effects. However, the draft legislation remains limited in several respects, such as the prohibition of online gambling, the non-recognition of gambling debts as legally enforceable obligations, and the absence of comprehensive preventive regulatory mechanisms.
This study analyzes the legal challenges of regulating casino establishments in Thailand under the aforementioned draft law. It further conducts a comparative legal analysis with regulatory models from Australia, Singapore, and the United Kingdom jurisdictions recognized for their effective multi-tier licensing systems, differentiated taxation structures, advertising controls, specialized regulatory agencies, and consumer protection mechanisms. The findings indicate that Thailand’s draft law lacks critical regulatory components, such as a legal definition of online casinos, a structured licensing framework, adequate tax provisions, and mechanisms for platform accountability and advertising oversight. Therefore, legislative reform is recommended based on comparative legal principles and adapted to the Thai socio-legal context to ensure effective regulation of the casino industry while preserving national moral and cultural values.
