FREEDOM OF EXPRESSION OF PUBLIC OFFICIALS

Abstract

This article aims to examine the legal issues concerning the freedom of expression of public officials in Thailand, with a particular focus on balancing their fundamental rights as citizens and their duties as state officials under the legal framework. The study explores legal constraints that may affect public officials’ ability to express opinions in various contexts, such as political neutrality and the use of social media. The research analyzes relevant Thai laws and regulations and compares them with legal frameworks and practices in foreign jurisdictions, namely the Federal Republic of Germany, the Kingdom of Norway, and the United Kingdom, to identify applicable principles, boundaries, and approaches that could be adapted to the Thai context.

             The study finds that Thai law lacks clarity regarding the definition of “political neutrality” and the legal boundaries of expression for public officials. This vagueness leads to inconsistent interpretation and enforcement. In contrast, foreign legal systems tend to define these limits more clearly and in alignment with democratic principles. Based on the findings, this article proposes legal reforms to establish clearer criteria and boundaries for public officials' expression, reduce ambiguity, and prevent unjust enforcement. The goal is to promote public officials' freedom of expression in accordance with human rights principles and the expectations of a democratic society.
