Legal Issues Concerning Biometrics Data Under the Personal Data Protection Act B.E. 2562

The purpose of this study is to examine the legal issues, interpretation and enforcement of biometric data under the Personal Data Protection Act B.E. 2562. Several issues, including the definition of biometric data and biometric data collection, require technology to assist in data collection and process, such as face image, iris image and fingerprint image should be reconsidered. Unlike general personal information, such as name, surname, age, occupation, eating habits, general daily activities, biometric data is sensitive personal data that the personal data prefers them not to be disclosed. Due to unclear definitions and enforcement of the Personal Data Protection Act B.E. 2562, this study compares the said Act with the EU Laws in order to specify key differences. It is essential that the Personal Data Protection Act B.E. 2562 relating to biometric data be revised and clarified to prevent interpretation and enforcement issues.
