Strategies to Tackle the Problem of Minimum Capital by Foreign Investors in 10 Special Economic Zones (SEZs) of Thailand: A Study in the Problem of Minimum Capital Faced by Chinese Investors under the Foreign Business Act B.E. 2542 (1999)

Abstract

In 2014, the Thai Government had developed the Special Economic Zones (SEZs) where 10 border provinces, it aimed to collaborate CLMV (i.e., Cambodia, Laos, Myanmar, and Vietnam). In addition to those nations, China was another key investor in the eyes of Thai government. Notwithstanding, the Foreign Business Act B.E.2542 (FBA) is still problematic in the sense of legal enforcement. In the SEZs, for the example, Chinese investors still has some obstacles in bringing or sending “minimum capital” into Thailand. For this reason, the authors analyzed the problems of Chinese investors based on the “minimum capital” issue under the FBA.

From the study, Chinese investors are not privileged to extend the period of bringing the group of CLMV investors into Thailand. Since they are not foreign businessmen who come from countries that have investment promotion treaties between Thailand and foreigners in accordance with Section 10 of the FBA. As a result, the article was analyzed the pattern of legal problems and strategies for such requirement should have been reconsidered in flavor the equitable treatment for foreign investors.
