Legal Measures for the Remedies of Damages from Transboundary Movement of Harzadous Wastes and their Disposal under Basel Protocol

Abstract

Basel Protocol contains substantive principles on liability, compensation and remedies for damages as a result from transboundary movement of hazardous wastes and their disposal. The instrument also provides rules on financial, insurance and litigation matters. As Thailand has arranged to ratify this protocol, she should prepare relevant domestic sectors, especially enforcement system of domestic regulations. The system, expected to be improved, is contributory to satisfaction in the management of transboundary movement in pursuance to the objective of this protocol.มาตรการทางกฎหมายเพื่อการเยียวยาความเสียหายอันเนื่องมาจากการ เคลื่อนย้ายของเสียอันตรายข้ามแดนและการกำจัดภายใต้พิธีสารบาเซล

พิธีสารบาเซลมีข้อกำหนดเกี่ยวกับความรับผิด ค่าเสียหาย และการชดเชยเยียวยาความเสียหายอัน เนื่องมาจากการเคลื่อนย้ายของเสียอันตรายข้ามแดนและการกำจัด รวมถึงมาตรการทางการเงิน การ ประกันภัย และการฟ้องร้องบังคับคดี การที่ประเทศไทยมีนโยบายที่จะเข้าร่วมเป็นภาคีในพิธีสารฯ ดังกล่าว จึงต้องมีการเตรียมความพร้อมในหลายด้าน โดยเฉพาะอย่างยิ่งการศึกษาทบทวนถึงประสิทธิภาพของ กฎหมายที่ประเทศไทยตราขึ้นเพื่อรองรับข้อกำหนดตามพิธีสารฯ ว่ามีความเหมาะสมเพียงพอในการบริหาร จัดการความเสียหายและการเยียวยาความเสียหายอันเนื่องมาจากการเคลื่อนย้ายของเสียอันตรายดังกล่าว หรือไม่
