LEGAL MEASURES FOR CONTROL OF ALIEN SPECIES: THE COMPARATIVE STUDY OF JAPANESE AND THAI LAWS IN THE CASE OF ARAPAIMA GIGAS

Abstract

This article aims to study the problems and legal measures for control alien species: The comparative study of Japanese and Thai law in the case of Arapaima Gigas. This research focused on related documents and comparative law.

According to the study, Thailand has several laws relating to control alien species. These laws are scattered. Each law has a different purpose. At the present, Thailand does not have specific laws relating to the prevention, control or eradication of alien species as Invasive Alien Species Act 2004 in Japanese law. Although, Thailand does not have any laws to be efficient fully enforced and protect biodiversity in accordance with the Convention on Biological Diversity. The existing laws show that lack of unity. It may not fully promote or support any management of measures related to the alien species.

Therefore, this problem should be solved or prevented urgently by issuing specific legal measures for implementing, solve problems, prevent and control invasion of alien species such as take an appropriate guideline legal measures from abroad for issuing specific legal measures for managing invasive alien species. In order to effectively manage alien species within the same standard and no confusion when enforce the law.
