Abstract

This research aimed to study and find out recommendations to develop and improve the law by prescribing measures to punish offenders of motorcyclists exceeding the appropriate legal rate.

         The findings found that the driving of speed bikes in communal areas is one of the key factors in which accidents are more prone to accidents than in other areas, so speed determination in such areas is an important tool to mitigate such risk factors. However, Thailand has not set a specific case in any way. And currently, the punishment for motorcyclists exceeding the rate specified by the law in Thailand has a fixed penalty, the penalty level is not divided according to the severity of the offense, therefore it is insufficient and inconsistent with the liability of the offender, also not being decisive enough to make the perpetrator choose not to commit an offense for such an offense. In addition, the study recommended speed limits in community areas and the degree of severity of offenses at varying speeds, as well as heavier penalties for recidivism of offenders.
