THE RIGHT TO RECEIVE PAYMENT AND DISPUTE RESOLUTION BY ADJUDICATION FOR THE CONSTRUCTION CONTRACT

Abstract

There  is  no  specific  laws  governs  the construction contract. The Civil and Commercial Code as to hire of works has inadequate provisions to govern to the contraction which has specific details. The payment to be received for construction works are major disputes between parties  attributable to insecurity of the construction industry.   Thus, the law of construction contract should be enacted to protect right of  the  parties  regarding  the  payments under the construction contract  by  having  specific  measure  for  fair and prompt dispute resolution.
