Abstract

Thailand class action law is drafted by receiving a legal concept from United States of America which may cause an effect that some rules are unsuitable for Thailand legal system which is Civil law. Due to class attorney is the most important person in a class action even in the case of claiming rights under special laws. Those unsuitable rules are also including a method to decide an attorney fee award, which is punitive damage to the losing defendant.
