THE DETERMINATION OF TELEVISION PROGRAM BROADCASTING ACCORDING TO MUST-CARRY RULE AND MUST-HAVE RULE : STUDY ON THE BROADCASTING OF SPORT PROGRAMS IN THAILAND

Abstract

The Notification on the Criteria for Free Television Broadcasting (The Must-carry Rule) and The Notification on the Criteria for the Important Events which can be Broadcasted only on Free Television (The Must-have Rule) contains certain provisions which affect the broadcasting of sport programs of television business operators and have many legal issues in different aspects. They are also not precise, unclear and inconsistent with the market conditions and the context in which the rules are laid down is not like the cases where it is enforced abroad. Therefore, the Must-carry Rule shall be reviewed, modified, and amended and the Must-have Rule shall be repealed and substituted by other legal measures.
