APPROPRIATENESS FOR LAO PDR TO ACCEDE TO THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS 1980

Abstract

There has been an effort to harmonize law on international sale of goods so that it is internationally accepted in any jurisdiction.  Example is CISG that has been adopted by many countries.  For Lao PDR,
the volume of international sale of goods in terms of import and export value has been increasing every year and dispute arising therefrom have also been increasing. However many trading countries chose not to specify Lao PDR’s law or its Court of Justice as their choice of law and choice of forum, so there are less cases of this nature to be presented to Lao PDR’s Court for adjudication.  This may result from an absent of specific law to govern and resolve any dispute arising from international sale of goods contract.

Therefore in order to solve these problems, Lao PDR should adopt CISG and implement the provisions to all dispute arising from international sale of goods contract and no reservation thereto should be made.
