GUIDELINES FOR DEVELOPING PRODUCT SAFETY LAW IN ASEAN : A COMPARATIVE STUDY OF THE EUROPEAN UNION

Abstract
The control of product quality and safety is very essential to the effectiveness of ASEAN single market. However, ASEAN still has no Product Safety Law, and existing measures for product safety are ineffective and problematic. In comparison, the European Union (EU) establishes and enacts the “General Product Safety Directive 2001/95/EC” (GPSD) to ensure that only safe products are placed on the market. Hence, to improve the control of product safety and facilitate ASEAN single market, “ASEAN General Product Safety Guidelines” should be established according to the model provided by the EU and set forth as standards or basic rules among ASEAN member states.
