CIVIL SANCTIONS AND CRIMINAL SANCTIONS MEASURES ON THE SECURITIES AND EXCHANGE ACT

Abstract

Thailand has enacted Civil sanctions against some specific offenses of the Securities law. Civil sanctions will be used to punish instead of Criminal sanction by focusing on punishment against offender’s property. But as the regulation of Civil sanction enforcement against criminal offenses causes conflicts with the basic concepts of Criminal sanctions measures. But is there any conflict with the basic concepts of Civil sanctions, and whether Civil sanctions must have Criminal Safeguard or not?
