LEGAL PROBLEMS CONCERNING PERSONAL DATA PROTECTION IN LIFE INSURANCE BUSINESS

Abstract
Life insurance business is a business that needs to involve personal data, both general personal data and sensitive personal data. Involved party in the collection, use or disclosure of personal data include life insurance companies, life insurance brokers, reinsurance companies, and claims management companies. In addition, Thailand has enacted the Personal Data Protection Act B.E. 2562. It is a general regulation of personal data protection in the same way as the General Data Protection Regulation of the European Union. However, that Act is still provisions that may not comply with the rules for international personal data protection. Include a problem in using, interpretation, and implementation which is a barrier for life insurance business operators. Therefore, it is appropriate to amend the provisions of the Personal Data Protection Act B.E. 2562 to be consistent with international regulations. Moreover, using or interpretation of the law in accordance with the intention of law and practical possibilities of the business sector. Including the Personal Data Protection Board should cooperate with the insurance business regulators to issue guidelines on the protection of personal data.
