LEGAL PROBLEMS ON THE ANIMAL EPIDEMICS ACT B.E. 2558 (2015) : CASE STUDY OF ONLINE PET SALES OPERATIONS

Abstract
At present, the online pet selling business is widely popular because selling pet businesses online has some advantages. That is, the seller does not have to find a place to make a shop, and it is also convenient for buyers to choose pets. On the other hand, the author found that this business causes some problems concerning animal welfare inspection and registration avoidance. In an attempt to solve the problems, the author has studied the Animal Epidemiology Act, B.E. 2558 (2015) and the roles of authorities concerned by taking into consideration the legal concepts on the same issue from the laws of Republic of India.
From the study, it is found that the Animal Epidemiology Act still has many legal problems; it is not comprehensive enough, obsolete and lacks of subordinate law and proper law enforcement. The author therefore has 3 suggestions as follows: First, the relevant agencies must issue an announcement to add more types of animals for import, sale and transport control. Second, the legal principles of the Republic of India are to be adopted in issuing the ministerial notification to specify the rules, procedures for raising and selling pets for pet shops And finally, There should be more coordination between the Department of Livestock Development and the Department of Business Development.
