LEGAL PROBLEMS RELATED TO SUPERVISION OF CYBERBULLYING AMONG CHILDREN AND YOUTH

Abstract

The purpose of this article was to propose thesis content on legal problems related to supervision of cyberbullying among children and youth. The study and analysis were conducted through related legal documents. The findings from the study show that at present network communication is a cause of wrongdoing developed from physical bullying to online bullying. Cyberbullying has become increasingly severe and affected emotional, mental, and physical conditions of victims, especially children and youth, leading to effects on learning and social development. Based on the study, there is no specific cyberbullying law that addresses such issues in Thailand. It is unable to directly search for definition of terms, offences, and agencies in charge but the search is conducted from relevant legal provisions such as Thailand Criminal Code, The Commission of Computer-Related Offences Act B.E. 2550 (2007) and Amendment B.E.2560 (2017). However, they could not provide comprehensively and explicitly coverage. Compared to other specific foreign laws such as Intimate Images and Cyber-protection Act 2017 (Nova Scotia, Canada) or Enhancing Online Safety Act 2015 (Australia) that specify definition of terms, offences, and agencies in charge of implementing cyber protection, reviewing contents that may contain cyberbullying, and measures on rapid problem solving. Therefore, this study proposes a specific law on cyberbullying to be formulated separately so as to be able to specify contents of the protection in a comprehensive and explicit manner.
