LEGAL PROBLEMS OF LACKING CONTROL RULES FOR SEEKING EVIDENCE IN COMMUNICATIONS BETWEEN LAWYER AND ACCUSED IN CRIMINAL

Abstract

In the country, there are criminal procedure which is accusatorial system and prosecution by the state, the accused will be able defense themselves to the prosecutor in equality and receive the right to fair trial when criminal procedure law guarantees that they have an effective legal assistance from their lawyer. The accused’ s lawyer play important roles in offering legal advices , helping and protecting the accused from errors or abuse of power by state officers. He will be able give the effective advices and assistances when the communications between him and accused were protected to keep secrecy, do not force to disclose and interfere when they are not consent. From the research and comparative analysis with England and France criminal procedure law found that Thai Criminal Procedure Code is outdated and lacking clear regulations for investigations not impacting the communications between lawyer and accused.


            These legal problems were studies “The legal problems of lacking rule to control seeking evidence in the communications between lawyer and accused in criminal” to formulate recommendations for improving and updating the regulations of investigation involving the communications between lawyer and accused in Thai Criminal Procedure Code.

ในขณะที่การสอบสวนเบื้องต้น คือ การสอบสวนคดีความผิดธรรมดา ลักษณะของการสอบสวนจึงต้องมีมาตรการบังคับที่กระทบกระเทือนสิทธิของบุคคล ผู้ต้องสงสัย หรือผู้ต้องหาน้อยกว่าการสอบสวนความผิดซึ่งหน้า
27.อนึ่ง ในการใช้อำนาจเรียกให้ส่งพยานหลักฐานของเจ้าพนักงานตามประมวลกฎหมายวิธีพิจารณาความอาญาของไทย ปรากฏอยู่ในลักษณะ 2 หมวด 1 ว่าด้วย การสอบสวนสามัญ มาตรา 132(3) เช่นกัน แต่จากการศึกษาบทบัญญัติในวิธีพิจารณาในการสอบสวนสามัญทั้งหมดนั้น ไม่ปรากฏบทบัญญัติให้สิทธิผู้ถูกเรียกให้ส่งพยานหลักฐานปฏิเสธไม่ส่งสิ่งของตามเรียกได้
