ข้อเสนอทางกฎหมายเพื่อการรับรองสิทธิในอากาศสะอาดในระบบกฎหมายไทย

Abstract
This article examines problems related to the right to clean air. Thailand currently faces air pollution issues, especially in terms of fine particulate matter (pm 2.5) spreading nationwide and damaging physical health, leading to increasing numbers of untimely deaths. As a result, the Constitution of the Kingdom of Thailand, B.E. 2550 (2007) was repealed and replaced by the Constitution of the Kingdom of Thailand, B.E. 2560 (2017) which removed section 67 of the 2007 constitution protecting the right to live in a healthy environment with clean air. Some researchers assert that protection of the right to clean air was included in section 43 (2) as the right to participate in the environment in the 2017 constitution, bolstered by such laws as the Enhancement and Conservation of National Environmental Quality Act, B.E. 2535 (1992) and National Health Act, B.E. 2550 (2007). Nevertheless, protecting the right to clean air provided governmentally to citizens has yet to be demonstrated conclusively.
Therefore, this article included an international comparative legal study of how other acts protect the right to clean air: the International Covenant on Civil and Political Rights (ICCPR) and International Covenant on Economic Social and Cultural Rights (ICESCR), as well as measures for the right to clean air in South Africa and England to derive improvements for Thailand.
Results were that the right to clean air in Thailand may be promoted in three ways: 1) using the legal measure to protect the right 2) regulating the right constitutionally and 3) regulating the right by law. In South Africa protecting the right to live in a healthy environment, including a right to clean air was integrated into the constitution and laws. In addition, England attempted to promote regulating the right to clean air in Parliament. Thailand might use comparable approaches to improve current legal enforcement.
