The Adequacy of measures to preventing corruption in public procurement in local administrative organizations: A Preliminary summary of the rational choice theory

This article aims to analyze measures to prevent corruption in procurement in Thailand to reflect those past measures to prevent corruption in procurement in Thailand is still not effective. Even though 3 important laws have been enacted, namely the Act Governing Offences Concerning Price Offers to State Agencies, B.E. 2542 (1999), the Public Procurement and Supplies Administration Act, B.E. 2560 (2017) and the “Organic Act on Anti-Corruption B.E 2561. (2018)”, which stipulate criminal penalties. both imprisonment and fine. Importantly, the latest law also gives the Anti-Corruption Commission the authority to take action with clear disciplinary punishment for government officials of local government organizations. In the interest of transparency in public procurement, implementing the information and communication technology in the procurement process (e-Government Procurement), the government fiscal management information system (GFMIS) and the Integrity Pact are new initiatives to cause the public to have participation in the observation of any of the procurement processes. An integrity pact under the Public Procurement Act allows observers with the knowledge, expertise or experience necessary for the procurement project concerned, who shall observe the overall procurement process and must be report corruption-prone procurement behaviors to relevant agencies for clarification or correction. But the results have not yet been achieved and are also related to the level of support of civil society organizations that are accepted in society. This reflects the inadequacy of external prevention measures and the need to adopt internal control measures that affect the decision to commit corruption within the framework of the Rational Choice Theory is taken into consideration in order to present guidelines for preventing corruption in public procurement.
