Abstract

มาตรการทางกฎหมายในการควบคุมผู้ขับขี่รถแท็กซี่มีกฎหมายที่เกี่ยวข้องอยู่หลายฉบับ คือ พระราชบัญญัติรถยนต์ พ.ศ. 2522 พระราชบัญญัติจราจรทางบก พ.ศ. 2522 และพระราชบัญญัติ การขนส่งทางบก พ.ศ. 2522 แต่บทบัญญัติและมาตรการทางกฎหมายที่บังคับใช้ไม่สามารถใช้บังคับ ได้อย่างมีประสิทธิภาพในการป้องกันการก่ออาชญากรรมที่เกิดจากผู้ขับรถแท็กซี่ได้ จากการศึกษากฎหมาย ดังกล่าวข้างต้นจึงพบปัญหาดังนี้ ปัญหาการจัดทำประวัติคนขับรถแท็กซี่ ปัญหาการบังคับใช้กฎหมาย เพื่อควบคุมการมีและใช้เครื่องสื่อสารและมาตรค่าโดยสารของรถแท็กซี่ ตลอดจนปัญหาการกำหนด คุณสมบัติและลักษณะต้องห้ามของผู้ขับรถแท็กซี่ รวมทั้งการกำหนดประเภทใบอนุญาตขับรถแท็กซี่ จึงได้เสนอแนะแก้ไขเพิ่มเติมหลักกฎหมายที่เกี่ยวข้องในเรื่อง การจัดทำประวัติผู้ขับรถแท็กซี่ การกำหนด มาตรการและบทลงโทษที่เกี่ยวกับการมีและใช้เครื่องสื่อสารรวมทั้งมาตรค่าโดยสารให้มีสภาพที่บังคับ ที่เคร่งครัดและชัดเจน การกำหนดคุณสมบัติและลักษณะต้องห้ามตลอดจนเกณฑ์อายุของผู้ขับรถแท็กซี่ ให้มีความเหมาะสมมากยิ่งขึ้น รวมทั้งควรมีการกำหนดให้มีใบอนุญาตขับรถแท็กซี่ไว้เป็นการเฉพาะ เพื่อการป้องกันปัญหาอาชญากรรมที่อาจเกิดขึ้นบนรถแท็กซี่ให้มีประสิทธิภาพ
