Abstract
This article examines the problems of provisions relating to the criteria for determining criminal liability in the case of using medical assisted reproductive technology with single women, according to the Protection Of a Child Born By Medically Assisted Reproductive Technology Act, B.E. 2558. This research is considered in terms of the best interest of the child principle, criteria for determining criminal liability of the medical practitioner, along with studying the foreign laws. From the research, I found that the chapter defines criminal liability in the case of providing services to single women still do not comply with the criteria for determining criminal liability. Therefore, the author considers that there should be an amendment to the provisions of the offense and punishment in the said Act.
