A COMPARATIVE STUDY BETWEEN THAI AND ENGLISH LAW

Abstract

Principles of law involving misrepresentation in Thailand focus on the case of fraudulent representation, which appears as the law of fraud under the Civil and Commercial Code. The Code does not clearly refer to negligent and innocent misrepresentation. The legal consequences of negligent and innocent misrepresentation in Thailand were studied. Whether to considered them as fraud was investigated, and if not, whether any remedy was available for representees. A comparative study of English law was employed to help create guidelines to better protect representees in Thailand in the future.
