OFFENCE OF DISCRIMINATION

บทคัดย่อ

Discrimination against any person because of differences of ones nationality, religion or sex is a wrongful action and needed to be punished by law. It is not only depriving human rights, but also devaluing of human dignity. Unfortunately Thai legislations relating to the protection from discrimination still lack clear and effective enforcement, and are not comprehensive enough to suppress crime provided that it does not prohibit such crime committed by non-State sectors. Due to such ineffective and incomprehensive legislations, Thailand has been subjected to chronicle problems emanated from discrimination. Therefore, the only way out to the problems for Thailand is to criminalize the acts of discrimination and made such offenses punishable by appropriate penalties.

            Accordingly, the purpose of the journal is to study the concept and approach of criminalization of the discrimination acts and punishment in foreign legislations in order to propose the most appropriate approach for Thailand to prescribe provisions specifically governing the acts of discrimination and establish a mechanism to ensure the effective enforcement
