บทคัดย่อ
รัฐมักกำหนดเขตแสดงตนเพื่อป้องกันภัยทางอากาศ (เขต ADIZ ) ครอบคลุมห้วงอากาศนอกบริเวณที่รัฐมีอำนาจอธิปไตย ทำให้เกิดประเด็นในทางกฎหมายระหว่างประเทศว่ารัฐอาศัยเขตอำนาจใดในการออกกฎหมายภายในบังคับอากาศยานของรัฐอื่น บทความนี้จึงศึกษาหลักกฎหมายระหว่างประเทศประกอบกับแนวปฏิบัติของประเทศ 4 ประเทศ คือ สหรัฐอเมริกา แคนาดา จีน และไทย เพื่อพิจารณาถึงความชอบด้วยกฎหมายระหว่างประเทศของเขต ADIZ บทความนี้พิจารณาเขตอำนาจตามกฎหมายสนธิสัญญาและจารีตประเพณีระหว่างประเทศ และพิจารณาการใช้สิทธิป้องกันตนเองในฐานะเหตุผลในการประกาศเขต ADIZ บทความสรุปว่าไม่มีกฎหมายระหว่างประเทศใดให้อำนาจรัฐออกกฎเกณฑ์เกี่ยวกับเขต ADIZ นอกห้วงอากาศเหนือดินแดนของรัฐ ด้วยเหตุนี้บทความจึงพิจารณาบทบาทขององค์การการบินพลเรือนระหว่างประเทศในฐานะองค์การระหว่างประเทศที่มีวัตถุประสงค์กำกับดูแลความปลอดภัยในการเดินอากาศระหว่างประเทศ และเสนอให้องค์การการบินพลเรือนระหว่างประเทศอาศัยกรอบอำนาจเรื่องความปลอดภัยในการเดินอากาศระหว่างประเทศออกมาตรฐานหรือข้อปฏิบัติที่แนะนำในภาคผนวกหรือคู่มือเพื่อกำกับดูแลเรื่องเขต ADIZ และหากมีข้อสงสัยเกี่ยวกับสถานะของเขต ADIZ ให้ส่งเรื่องไปขอความเห็นแนะนำจากศาลยุติธรรมระหว่างประเทศ
