Model Law for the Implementation of Specific City Plan

Abstract

               The objective of the research is to issue law for the implementation of specific city planning law of Koh Chang Community (West coast), Trat Province. Research methodology is qualitative research, including documentary research; in-depth interview; participatory design, co-design; and hearing. 

              The research found out that  Koh Chang is a tourism place which meets the 5 factors for the determination of specific city plan are criteria to select the area; structure of specific city plan; operation organizations; people participation; and law for the implementation of specific city plan. The  model law on the specific city  plan of Koh Change has 32 provisions consisting of Chapter 1 General Provision; Chapter 2 Specific Use of Land; Chapter 3 Measures to Comply with the Objectives of Specific City Plan; and Chapter 4 Punishment and Transitional Provisions.

            The research recommendation is to issue Ministerial Regulation to specify the detail for the  law enforcement, and to amend the City Plan Act, B.E. 2518. The Local Administration Organization shall be the committee member of the City Plan Committee. The setting up of specific city plan should be according of the people preferences by the authority and duty of Provincial Administration Organization. The recommendation of further research is  to continue study for setting up specific city plan of Koh Change, East coast in order to conserve an agricultural community.
