A Study of Class Action Guidelines for Cybercrime Cases

Abstract
This academic article examines class action guidelines for cybercrime cases in light of the rapid advancement of technology, which has increasingly enabled offenders to use digital tools to commit complex, large-scale offences. Computer crime cases today often involve a large number of victims and share common features, including similar methods of commission, the same factual background, the use of the same platforms or locations, the involvement of the same group of offenders, and comparable patterns of unlawful conduct. Under such circumstances, ordinary procedural mechanisms in criminal proceedings, such as joinder of cases or intervention by related parties, may be insufficient or unsuitable for the effective adjudication of computer crime cases. This article explores the background, significance, and potential benefits of class action proceedings in the context of computer-related crime. It argues that such an approach could contribute positively to the criminal justice system by reducing the burden of individual litigation, which is often costly and time-consuming, lowering administrative and investigative costs for the state, and allowing a shared body of evidence to be used efficiently across multiple claims. Class action proceedings may promote fairness by enabling victims to recover compensation proportionate to their losses and by ensuring that offenders are punished in accordance with the number and gravity of their criminal acts. The article also presents a comparative analysis of class action approaches adopted in foreign jurisdictions to address computer crimes affecting large numbers of people, such as personal data theft, hacking, online data falsification, malware attacks, and fraud. It further discusses major challenges in applying class action proceedings to computer crime cases, including the geographical dispersion of victims, jurisdictional issues, legal representation, the value of claims, and the nature, type, and origin of the cause of action. Based on this analysis, recommendations are proposed to improve the prosecution of computer crime cases and to strengthen legal responses to this form of transnational, technology-driven crime. The study concludes that class action proceedings in computer-related fraud and cybercrime cases can serve as an effective legal mechanism for delivering timely, efficient, and equitable justice to victims, and may provide an appropriate alternative for addressing the growing complexity of computer crime in contemporary society.
