Abstract
This study aims to discuss the implementation of child care (of custody) in Malaysia. Research focus is on the implementation of custody rights contained in the Islamic Family Law in Malaysia. Implementation in Malaysia provided in the Family Law Enactment Islam under the jurisdiction of their respective states. The research methodology for collecting data is through the study of literature to refer books of fiqh, law journals and court case files, in addition, data are collected through interviews with lawyers and judges interview Syariah court. The results summarized into two main areas: first, provisions in respect of custody in Family Law Enactment of each country is in line with Islamic law. Secondly, in terms of implementation principles adopted by the Syariah Court when considering the facts of the case over the interests of the welfare of children against the interests of the husband and wife quarrel, in line with Islamic requirements. The demands contained in the enactment of any country that arise in a divorce case is nursing child rights, child support and alimony in waiting, muta'ah and matrimonial property
