ปัจจัยที่ส่งผลต่อการกระทำความผิดเกี่ยวกับคดียาเสพติดยาบ้าของผู้ค้า ที่เป็นนักโทษเด็ดขาดในเรือนจำพื้นที่เขต 5 ในประเทศไทย

Abstract

บทคัดย่อ

การวิจัยครั้งนี้ มีวัตถุประสงค์คือ 1) เพื่อศึกษาความแตกต่างภูมิหลังของผู้ค้าซึ่งเป็นนักโทษเด็ดขาดในเรือนจำ 2) เพื่อวิเคราะห์ปัจจัยที่ส่งผลต่อการกระทำความผิดเกี่ยวกับคดียาเสพติดประเภทยาบ้า และ3) เพื่อเสนอแนะแนวทางที่เป็นประโยชน์ต่อการป้องกันปราบปรามการกระทำความผิดเกี่ยวกับการค้ายาบ้าต่อหน่วยงานที่เกี่ยวข้อง ใช้ระเบียบวิธีการวิจัยการวิจัยเชิงปริมาณ และการวิจัยเชิงคุณภาพ โดยใช้ Multiple Regression Analysis และ T-test เครื่องมือที่ใช้ในการวิจัยใช้แบบสัมภาษณ์และแบบสัมภาษณ์เชิงลึก

ผลการวิจัยพบดังนี้  1) ผู้ค้าซึ่งเป็นนักโทษเด็ดขาดในเรือนจำ รายย่อยและรายใหญ่มีภูมิหลังแตกต่างกัน  2) ในภาพรวม ตัวแปรที่สามารถพยากรณ์การกระทำความผิดฯ มี 2 ตัวแปร ได้แก่ ก) ปัจจัยสาเหตุส่วนบุคคล และ ข) ปัจจัยการใช้ชีวิตทางสังคมที่เอื้อต่อการสร้างเครือข่าย ตัวแปรที่สามารถพยากรณ์ฯผู้ค้ารายย่อย คือ นักโทษเด็ดขาดที่ถูกจำคุกในเรือนจำน้อยกว่า 10 ปี  มี 3 ปัจจัย ได้แก่ ก) ปัจจัยสาเหตุส่วนบุคคล ข) ปัจจัยด้านโอกาสเข้าถึงยาเสพติด และ ค) ปัจจัยการใช้ชีวิตทางสังคมที่เอื้อต่อการสร้างเครือข่ายโดย ตัวแปรที่สามารถพยากรณ์การกระทำความผิดเกี่ยวกับการค้ายาเสพติดฯรายใหญ่ คือ นักโทษเด็ดขาดที่ถูกจำคุกในเรือนจำมากกว่า 10 ปี มี 1 ตัวแปร ได้แก่ ปัจจัยการใช้ชีวิตทางสังคมที่เอื้อต่อการสร้างเครือข่าย  3) แนวทางการป้องกันปราบปรามการกระทำความผิดเกี่ยวกับการค้ายาบ้า ควรประกอบด้วย ด้านปัจจัยสาเหตุส่วนบุคคล คือ การจัดอบรมเยาวชน การสอดส่องดูแลภายในหมู่บ้านชุมชน ส่งเสริมอาชีพ  ทั้งนี้ปัจจัยด้านโอกาสเข้าถึงยาเสพติด คือ ไม่ควรให้มีแหล่งอบายมุข การประชาสัมพันธ์ให้ชาวบ้านมีส่วนร่วม ภาครัฐควรติดตามตรวจสอบพฤติกรรมบุคคลที่เกี่ยวข้องยาเสพติด การสกัดกั้นเส้นทางการลำเลียง ส่วนปัจจัยการใช้ชีวิตทางสังคมที่เอื้อต่อการสร้างเครือข่าย ได้แก่ การปราบปรามผู้ค้าอย่างจริงจัง การลงโทษโดยเฉียบขาดและรวดเร็วมีกฎหมายเอื้อต่อการตรวจค้น จับกุม การให้การลดโทษแก่ผู้ให้ข้อมูล นอกจากนี้ผู้ที่มีการกระทำความผิดซ้ำ ต้องรับโทษเพิ่มขึ้น

ABSTRACT

The objective of this research were to 1)to study the difference in background of the court in prisons, 2) to analyze the factor that influence the people to convict narcotic drug amphetamine offers and 3)to suggest a better mechanisms to prevent for the organizations working against this drug. The research methodology were used the method of qualitative and quantitative. The statistical analysis were used to Multiple Regression Analysis and T-test. Interview schedule and in-depth interview guidelines were used as data collection.

The main results were: 1)The background of the prisoners less 10 years were difference from the background of the prisoners more than 10 years. 2)In general the independent factors that predict the number of years in prison were a) Individual characteristics and b) the way of Living that result to networking among the sellers of narcotic drug. The minor sellers that were forced to stay in prison less than 10 years there were 3 factors which were a) individual characteristics b) chance of accessing to drug amphetamine and c) the way of living that result to networking among the sellers of narcotic drug. The big sellers that were forced to stay in prison more 10 years and result there was one factor; the way of living that result to networking among the sellers of narcotic drug. 3)The better mechanism to prevent for the organization working against this drug should pay attention on the characteristic of the person that encourage people to commit this crime in setting various training sessions for the youth, inspect the suspect persons at the village level, promoting many careers for those who already complete their guilty and prevent them not to get involve with activities such as drinking and gambling etc. Which were them to narcotic drug, more local villages should be introduced to prevent narcotic drug and to stop the route that transport the narcotic drug. As far as the way of living that resulted to networking among the sellers of narcotic drug this study propose a strong suppression the sellers, quick action in judgment and request for easy law to inspect and control the suspect, reducing the guilt for those selling many times the more years in prison should be added to these convictions.
