Problem Legal Issues in Quality Standard of Fundamental Education

Abstract

The research focus on legal issues  in  quality standard of fundamental education by achieving the following objectives:: a) to analyze concepts, theories and related laws in order to develop lawsb) to determine quality standard on fundamental education and relevant study c) to analyze legal measures related to the determination on quality standard of fundamental education in Thailand and other countries d) to propose recommendations which will improve the quality standard of fundamental education in Thailand in order to comply with international standard. The researcher undertook a comparison study analyzing theories and legal measures related to the administration of fundamental education from other countries and Thailand. Consequently, the researcher intent to conduct interviews by choosing a target population sample groups including competent scholars and other individuals who have been directly involved. At last, the researcher has applied a content analysis approach to analyze the data and conclude possible recommendations regarding the laws in order to determine quality standards of fundamental education.

This research study identifies several problems relating the determination of quality standard within fundamental education in Thailand, as following:

     1) Educational inequality: Access to education for free. The government has initiated a policy that state that children have the right to study for 15 years without tuition costs. This policy, however, has not been carried out up to today.

     2) Size of schools: The problem with small schools is that there is a lack of teachers and staff and the annual budget provided to these schools for this particular purpose is insufficient.

     3) Private schools: Schools having been registered as juristic persons, leading to clear regulations on the determination of quality standard of fundamental education but only within its jurisdiction.

           The researcher is in the opinion that further research on concepts, theories, legal measures and relevant laws on the quality standard determination of fundamental education is highly necessary in order to seek for possible amendments that could benefit the fundamental education system in overall in Thailand and develop these legal measures to comply with the international standard.
