A Study of Civil Dispute Mediation by Mediators in Thailand

Abstract

The objectives of this research were: To study the civil mediation by mediators in Thailand by using the document research method, Using a documentary research method, the research synthesized documents and research in Thai from 2022-2025 and English from B.E. 1978-2012.

The results of this research found that:

The civil mediator by the mediator must proceed according to the following steps: 1) The opening speech step of the mediator must create knowledge and understanding of the justice process for the disputing parties 2) The opening speech step of the disputing parties and the conclusion of the speech must use communication skills and good questioning 3) The negotiation issue determination step must capture the real needs 4) The problem exploration step must be a medium to find a joint solution to resolve the conflict or manage the dispute 5) The joint proposal creation and exploration step must create and explore proposals together to create cooperation, trust, and understanding of the same goal 6) The proposal evaluation and negotiation step must evaluate the proposal and negotiate. It must analyze and resolve the conflicts of the disputing parties in the negotiation and mediation 7) The agreement conclusion and closing step must create an agreement to end the dispute that is fair, summarize the negotiation, summarize the negotiation results officially, have details, steps to lead to implementation and close the negotiation.
