สภาพปัญหาและอุปสรรคการบังคับใช้กฎหมายทางการศึกษาแก่บุคคลที่ไม่มีสัญชาติไทยของจังหวัดเชียงใหม่

บทคัดย่อ

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและอุปสรรคการบังคับใช้กฎหมายทางการศึกษาแก่บุคคลที่ไม่มีสัญชาติไทยในโรงเรียนมัธยมจังหวัดเชียงใหม่และเพื่อศึกษาแนวทางในการปฏิบัติที่สอดคล้องกับนโยบายของรัฐและการศึกษาของบุคคลที่ไม่มีสัญชาติไทย ของจังหวัดเชียงใหม่โดยเก็บรวบรวมข้อมูลจากประชากรและกลุ่มตัวอย่าง จำนวน 297 คนผู้วิจัยใช้โปรแกรมสำเร็จรูปทางคอมพิวเตอร์ในการประมวลผลและวิเคราะห์ข้อมูลสถิติที่ใช้ในการวิเคราะห์ข้อมูลได้แก่ ค่าความถี่ (Frequency) ค่าร้อยละ (Percentage) ด้วยการวิเคราะห์เชิงคุณภาพ พิจารณาความสอดคล้องและความสัมพันธ์ของข้อมูลการรับรู้นโยบายและการนำไปปฏิบัติ  ผลการวิจัยสรุปได้ดังนี้ 1. ปัญหาและอุปสรรคการบังคับใช้กฎหมายทางการศึกษาแก่บุคคลที่ไม่มีสัญชาติไทย พบว่า  1)บุคลากรทางการศึกษาไม่รู้ซึ่งกฎหมาย กฎ นโยบายทางการศึกษา 2) การออกกลางคันของนักเรียนที่ไม่มีสัญชาติไทย3) การจัดทำข้อมูลพื้นฐานของนักเรียน 4) สภาพแวดล้อม ชุมชน มีเจตคติที่ไม่ดีต่อบุคคลที่ไม่มีสัญชาติไทย 5) ด้านการเรียนการสอน 6) กิจกรรมหรือนโยบายจากหน่วยงานอื่น เป็นการเพิ่มภาระงานของโรงเรียนให้มากยิ่งขึ้น 2. แนวทางในการปฏิบัติที่สอสดคล้องกับนโยบายของรัฐ 1)ควรมีการประชาสัมพันธ์เผยแพร่ความรู้ 2) ควรมีการแนะแนวการนำนักเรียนเข้าสู่ 3) จัดทำฐานข้อมูลของนักเรียนเชื่อมโยงกับหน่วยงานอื่น4) เสริมสร้างความรู้ความเข้าใจชุมชน บุคลากรทางการศึกษา5) จัดการเรียนการสอนให้สอดคล้องอย่างเสมอภาคและเท่าเทียมกัน 6)  การจัดการศึกษาตามกฎหมาย นโยบายของรัฐอย่างเคร่งครัด

PROBLEMS AND OBSTACIES IN LAW ENFORCEMENT OF EDUCATION TO PERSONS NOT REGISTERED IN THAILAND OF CHIANG MAI PROVINCE 

The objectives of this thesis were to study problems and difficulties on applying educational laws to not registered persons in secondary schools in Chiang Mai,and to investigate the practices related to public policy and those people‘s education in Chiang Mai. The 297 samples were composed of a director in Chiang Mai secondary school Educational Area Office 34, school administrators and public teachers. Research data were analyzed by a computer program to identify frequency and percentage. The content analysis was also applied to find the conjugation, relation, policy perception, and practice on qualitative information.  The results were:1. The problems and difficulties on applying educational laws to not registerednationality people in Chiang Mai were:1) A lack of perception, comprehension, and information distribution of educational laws, rules and policy that resulted in a failure of policy practices, 2)Many dropouts ofnot registerednationality studentsbecause of moving with their labor parents,3) Student data caused problems of school administer. 4) Some people, educational officer and community had some negative thinking on not registerednationality people. 5) A problems of learning and teaching between teacher and not registered nationality, 6) The policy and activities assigned from other organizations created more school workloads. 2. The guidelines of educational provision to not registeredrelated to the government policy were: 1) should be publicly and currently made to related people 2)School guidance should be provided for students 3) Data base of those not registerednationality students should be linked to other organizations4) Information and comprehension for positive thinking on not registerednationality people 5)Learning should be precisely and equally managed to all students6) Education should be strictly provided to the laws and policy of the government
