ปัญหาการบังคับใช้กฎหมายขององค์การบริหารจัดการประมงระดับภูมิภาคกรณีทรัพยากรสัตว์น้ำคร่อมเขตและชนิดพันธุ์อพยพย้ายถิ่นไกล

บทคัดย่อ
องค์การบริหารจัดการการทำประมงระดับภูมิภาคและอนุภูมิภาค (RFMO/As) เป็นกลไกทางกฎหมายในการควบคุมการทำประมงทรัพยากรสัตว์น้ำคร่อมเขตและชนิดพันธุ์ย้ายถิ่นไกล แต่การดำเนินการให้บรรลุผลตามเป้าหมายของความตกลงเพื่อการปฏิบัติตามบทบัญญัติแห่งอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล วันที่ 10 ธันวาคม ค.ศ.1982 เกี่ยวกับการอนุรักษ์และการจัดการสัตว์น้ำชนิดพันธุ์ที่คร่อมเขตและย้ายถิ่นไกล ค.ศ. 1995 (UNFSA) ยังมีปัจจัยหลายประการที่ก่อให้เกิดปัญหาในการบังคับใช้กฎหมาย
ผลการวิจัยพบว่า UNFSA อยู่บนหลักความร่วมมือของรัฐที่เกี่ยวข้องซึ่งมีความยืดหยุ่นและปรับตามความร่วมมือของรัฐแต่ละพื้นที่ ลักษณะดังกล่าวส่งผลดีในแง่การกำหนดมาตรการที่เหมาะสมกับบริบทของพื้นที่และชนิดพันธุ์สัตว์น้ำแต่ในขณะเดียวกันเผชิญความท้าทายจากระดับความร่วมมือที่แตกต่างกันของรัฐสมาชิกของ RFMO/As ในเขตพื้นที่ต่างๆ
นอกจากนั้น เงื่อนไขในการเข้าทำประมงทรัพยากรสัตว์น้ำคร่อมเขตและชนิดพันธุ์ย้ายถิ่นไกลตาม UNFSA เพื่อการเข้าถึงการใช้ประโยชน์จากทรัพยากรสัตว์น้ำนั้น ส่งผลต่อรัฐสมาชิก และรัฐที่ไม่ได้เป็นสมาชิก UNFSA แต่ให้ความร่วมมือกับ RFMO/As เนื่องจากเงื่อนไขในการเข้าใช้ประโยชน์จากทรัพยากรสัตว์น้ำตาม UNFSA ถูกนำไปกำหนดไว้เป็นเงื่อนไขการใช้ทรัพยากรใน RFMO/As ด้วย
ทั้งนี้ รัฐเจ้าของธงเป็นตัวแปรสำคัญในการดำเนินการให้มาตรการอนุรักษ์และจัดการของ RFMO/As ประสบผลสำเร็จ เนื่องจาก UNFSA และกฎหมายขจัดการทำประมงผิดกฎหมาย ขาดการรายงานและไร้การควบคุมเพิ่มภาระให้แก่รัฐเจ้าของธงในการอนุรักษ์และจัดการทรัพยากรสัตว์น้ำในระดับภูมิภาค ทั้งจากแนวคิดเรื่องความรับผิดชอบของรัฐเจ้าของธงและการกำหนดให้รัฐเจ้าของธงต้องให้ความร่วมมือกับรัฐอื่น รัฐเจ้าของธงที่เป็นประเทศกำลังพัฒนาต้องรับภาระหนักในการดำเนินการดังกล่าว
การบังคับใช้กฎหมายตาม UNFSA พบว่า RFMO/As มีการปรับปรุงมาตรการขึ้นและตรวจเรือประมงโดยรัฐที่ไม่ใช่รัฐเจ้าของธงให้สอดคล้องกับข้อกำหนดของ UNFSA มากอื่น ปัญหาของการบังคับใช้กฎหมายคือมาตรการขึ้นและตรวจเรือยังไม่เป็นไปในแนวทางเดียวกันในทุกเขตทางทะเล อย่างไรก็ตาม แนวโน้มการกำหนดให้มีมาตรการขึ้นและตรวจเรือโดยรัฐอื่นที่มิใช่รัฐเจ้าของธงของ RFMO/As ได้เร่งให้เกิดการตรวจสอบการปฏิบัติตามและการบังคับใช้กฎหมายของ RFMO/As
นอกจากนั้น การให้ความร่วมมือของประเทศสมาชิกและประเทศที่มิใช่สมาชิกแต่ให้ความร่วมมือกับ RFMO/As ในการดำเนินการตามข้อกำหนดของ RFMO/As ตลอดจนความร่วมมือในการสร้างกลไกทางกฎหมายในระดับภูมิภาคหรืออนุภูมิภาคเพื่อตรวจสอบการทำประมงในเขตต่างๆทางทะเล เป็นปัจจัยสำคัญในการป้องกัน ยับยั้ง และขจัดการทำประมงที่ผิดกฎหมาย ขาดการรายงานและไร้การควบคุมที่อาจพ้นจากการตรวจสอบได้
