บทคัดย่อ
นักกีฬาอาชีพหญิงได้เข้าสู่วงการกีฬาสหรัฐอเมริกาเป็นจำนวนมาก แต่กระนั้นนักกีฬาอาชีพชายมักได้รับค่าจ้างมากกกว่านักกีฬาอาชีพหญิงในวงการกีฬาอาชีพสหรัฐอเมริกา ช่องว่างรายได้ระหว่างเพศในวงการกีฬาอาชีพและข้อวิตกเกี่ยวกับประเด็นปัญหาดังกล่าวได้ถูกสะท้อนในบริบทระดับชาติ เมื่อเร็ว ๆ นี้ ทีมฟุตบอลหญิงทีมชาติสหรัฐอเมริกาได้ฟ้องร้องนายจ้างของตนเอง ได้แก่ สหพันธ์กีฬาฟุตบอลสหรัฐอเมริกา เพื่อเรียกร้องให้มีการจ่ายค่าจ้างอย่างเสมอภาคและการปฏิบัติอย่างเป็นธรรม กรณีศึกษาการจ่ายค่าจ้างที่ไม่เท่าเทียมระหว่างทีมฟุตบอลหญิงทีมชาติสหรัฐอเมริกาและทีมฟุตบอลหญิงทีมชาติสหรัฐอเมริกาได้ถูกหยิบยกมาทำการศึกษาในบทความฉบับนี้ การเลือกปฏิบัติในการจ่ายค่าจ้างให้ชายและหญิงที่ปฏิบัติงานอย่างเดียวกันในอัตราที่แตกต่างกันภายใต้รัฐบัญญัติของรัฐบาลสหรัฐอเมริกาว่าด้วยการจ่ายค่าจ้างอย่างเสมอภาค ค.ศ. 1963 ในฐานะที่เป็นกฎหมายแรงงานที่วางหลักเกณฑ์ห้ามเลือกปฏิบัติทางเพศด้านค่าจ้างและกำหนดให้นายจ้างจ่ายค่าจ้างให้ชายและหญิงที่ทำงานอย่างเดียวกันในอัตราที่เท่ากันได้ถูกหยิบยกมาศึกษาวิเคราะห์ในบทความฉบับนี้ ประสบการณ์ของสหรัฐอเมริกาย่อมกลายเป็นบทเรียนต่อประเทศไทยอันนำไปสู่ความท้าทายทางกฎหมายเกี่ยวกับการจ่ายค่าจ้างอย่างเสมอภาคถ้าหากปฏิบัติงานอย่างเดียวกันในอุตสาหกรรมกีฬา แล้วความท้าทายทางกฎหมายเช่นว่านี้ย่อมนำไปสู่การพัฒนากีฬาวงการฟุตบอลไทยในอนาคต
