บทคัดย่อ
แม้ได้มีการวางระเบียบเพื่อดำรงการรักษาเสถียรภาพในสัญญาและปกป้องความถูกต้องชอบธรรมในวงการกีฬาฟุตบอลสากลภายใต้การกำกับดูแลกีฬาฟุตบอลนานาชาติของ ฟีฟ่าแต่ศาลยุติธรรมแห่งสหภาพยุโรปได้มีคำพิพากษาซึ่งคุ้มครองเสรีภาพในการโยกย้ายถิ่นฐานของนักกีฬาในสหภาพยุโรป ในขณะที่นักกีฬาได้ย้ายออกก่อนสัญญาจะหมดอายุ และโดยเฉพาะอย่างยิ่งครอบคลุมไปถึงนักฟุตบอลอาชีพพึงมีสิทธิในเสรีภาพการเดินทางของคนทำงานภายในสหภาพยุโรป การยอมรับคำพิพากษาของศาลยุติธรรมแห่งสหภาพยุโรปไม่เพียงแต่สอดคล้องกับเป้าหมายด้านสิทธิมนุษยชนเท่านั้น เช่น การปกป้องเสรีภาพในการโยกย้ายถิ่นฐานในสหภาพยุโรป แต่ยังเป็นปัจจัยสำคัญเพื่อนำไปสู่การคุ้มครองสิทธิในการอนุญาตให้ผู้เล่นฟุตบอลอาชีพเดินทางภายในหรือระหว่างประเทศอย่างเสรี รวมทั้งเลือกสถานที่ทำงานและสถานที่สมาคมเพื่อเข้าร่วมกิจกรรมของสโมสรกีฬาฟุตบอลได้อีกด้วย บทความฉบับนี้มุ่งศึกษาคำพิพากษาที่วางหลักเกณฑ์ยืนยันว่ากฎระเบียบว่าด้วยการโอนย้ายนักกีฬาฟุตบอลข้ามสโมสรของฟีฟ่าได้ละเมิดสิทธิในเสรีภาพในการโยกย้ายถิ่นฐานของสหภาพยุโรป โดยวิเคราะห์จากมุมมองของคำพิพากษาของศาลยุติธรรมแห่งสหภาพยุโรปในคดีที่ C-650/22 Lassana Diarra and FIFPRO v FIFA and URBSFA โดยบทความฉบับนี้เพิ่มส่วนวิเคราะห์ที่สำคัญเกี่ยวกับการคุ้มครองเสรีภาพในการโยกย้ายถิ่นฐานของนักกีฬาฟุตบอลอาชีพในสหภาพยุโรปภายในกฎหมายของสหภาพยุโรป ขณะเดียวกันก็นำเสนอประเด็นน่าสนใจเกี่ยวกับการปรับใช้ของมาตรา 45 และมาตรา 101 ของสนธิสัญญาว่าด้วยการดำเนินงานของสหภาพยุโรป
